Perhaps with more irony than intended, April 1, 2013, marked the launch of ISO's first significant revision to the CGL program in six years.

While there were numerous updates, tweaks and revisions, provisions affecting Additional Insureds in both the standard CGL and AI endorsements may be the most crucial for agents and insureds to understand.

The new changes are well intended. But noble intentions are often undone by the "Law of Unintended Consequences."

  • And which may have actually made things worse?
  • Did ISO succeed in finally coming to grips with the often aggravating "primary and noncontributory" issue? Or not?
  • Has ISO inadvertently turned every construction contract into an ad hoc policy endorsement?
  • Even if the ISO language is an improvement, how do you know if a carrier is using it verbatim or just doing a "cut and paste" (often much to your unpleasant surprise)?
  • If ISO's answer is still the wrong one, now what?
