The Real Meaning of the Property Damage Exclusion in the CGL

The commercial general liability (CGL) policy form is complex, and understanding its exclusions is perhaps one of the most difficult tasks you may encounter.

Exclusion "j." in Part A of the CGL, which limits coverage for property in the insured's care, custody, or control or on which the insured is working, is an example of one such exclusion that is often misapplied and misinterpreted.

Exclusion "j." is designed to eliminate coverage for liability exposures that are better handled through some form of first-party insurance, such as an inland marine policy, builders' risk or a commercial property policy.

However, there are many gray areas in the exclusion that may not be clear. This class allows the student to better interpret and carefully scrutinize this exclusion to understand the breadth of the exclusion and the amount of coverage given by its exceptions.
